Terms and Conditions

These terms are an agreement between you and Nolan S., who runs Skate On. By using Skate On you agree to these terms, our Privacy Policy and our community guidelines, which are part of these terms. If you don't agree, please don't use Skate On.

Skate On is free. We don't sell anything through the site.

Please read this. Skateboarding and BMX can lead to serious injury. When you go to a spot or an event you find on Skate On, you do so at your own risk.

• Spots and events are added by riders, not checked by us. A spot can be closed, unsafe, broken, on private property or not as described.
• Events are run by the riders or groups who post them, not by Skate On. The organiser is responsible for the event.
• Check a spot before you ride it, wear protective gear, ride within your limits and follow local rules.

• You must be 13 or older.
• If you're 13 to 17, you need your parent's or guardian's OK. By letting you use Skate On, your parent or guardian agrees to these terms for you and is responsible for your account.
• Telling us the wrong age breaks these terms, and we may close the account.
• If the law where you live sets a higher age, that age applies.

• Give accurate information and keep your email address up to date.
• One account per person. Don't share your account or sign-in codes.
• You're responsible for what happens on your account. Tell us at kgotsonolan@gmail.com if you think someone else is using it.
• You can delete your account at any time. It's switched off straight away and permanently deleted after 60 days. Sign in before then to bring it back. Spots and upcoming events you added stay on Skate On and are looked after by our team. Your notes and suggestions stay and show as Deleted User, and your ratings and upvotes still count, without your name.

This covers spots, secret spots, events, photos, rider notes, comments, reviews, ratings, suggestions and your profile.

• It must be accurate and honest, and follow the community guidelines.
• Only post spots riders can reach without breaking in, and don't post tips for getting past fences, locks or guards.
• Only post photos you took or have permission to use. Don't post photos where people who didn't agree can be recognised, and never post photos of children who aren't yours.
• Mark a spot as secret if it only stays open when it stays quiet, and don't share a secret spot's exact location anywhere else on Skate On.
• Event organisers are responsible for their event information being correct, for any tickets, fees or links, and for running the event safely.
• One review per rider.

You keep ownership of what you post. You give us permission to store, show, resize and share it on Skate On and in our emails and social media posts about Skate On, for as long as it's on Skate On. When you delete something, we stop using it, apart from copies already shared or replied to and backups that are removed over time. If you delete your account, the things that stay on Skate On (see "Your account") keep this permission.

• Break the law or help someone else break it.
• Harass, threaten, bully or impersonate anyone, or post hate speech.
• Share someone else's personal details.
• Post spam, adverts dressed up as events, fake or duplicate spots and events, or false information.
• Post anything explicit or violent.
• Post anything that infringes someone's copyright or other rights.
• Try to break, overload, scrape or get around the security of Skate On, or create accounts automatically.

• Anyone signed in can report a spot, event, photo, note, review or rider.
• When three riders report the same thing, it's hidden until we've looked at it.
• We review reports and can dismiss them, hide or delete content, or warn, suspend or close accounts that break these terms or the guidelines. We'll usually tell you why.
• If you think we got it wrong, email kgotsonolan@gmail.com.

If something on Skate On uses your work without permission, email kgotsonolan@gmail.com with: your name and contact details, the work you own, a link to where it appears on Skate On, and a statement that the information in your complaint is true. We'll review it and remove the content if it infringes your rights. This follows the take-down process in South Africa's Electronic Communications and Transactions Act.

• We email sign-in codes and important account messages.
• Other notifications and the newsletter are optional. You can turn them off in your settings or unsubscribe from any email.
• If you install Skate On on your phone's home screen and allow push notifications, you can turn them off in your settings or your phone's settings.

The Skate On name, logo, design and software belong to us. Don't copy them or use them in a way that suggests you're Skate On or that we support you, without our permission.

We work hard to keep Skate On running and accurate, but we provide it "as is". We can't promise it will always be available, free of errors, or that spots, events and maps are correct. Maps are provided by OpenFreeMap using OpenStreetMap data and are subject to their terms.

As far as the law allows, we aren't responsible for:

• injury, loss or damage from riding at a spot or going to an event you found on Skate On;
• what other riders or organisers post or do;
• the site being unavailable, or losing content.

Nothing in these terms limits responsibility that can't be limited by law, including under South Africa's Consumer Protection Act, or your rights as a consumer where you live.

If you break these terms or the law and someone makes a claim against us because of it, you agree to cover our reasonable costs, as far as the law allows.

We may suspend or close an account that breaks these terms or the guidelines, that puts riders or spots at risk, or when the law requires it. Where it's safe and reasonable to, we'll warn you first and tell you why.

Anyone can use Skate On. These terms are governed by South African law. If you live somewhere else, you keep any rights the law where you live gives you that can't be taken away by an agreement, and you're responsible for following your local laws when riding and posting.

If something goes wrong, email kgotsonolan@gmail.com first and we'll try to sort it out together. If we can't, South African courts can decide it, unless the law where you live gives you the right to go to your local courts.

If we make important changes, we'll update this page and the date at the top, and let you know by email or on the site before they take effect. If you keep using Skate On after that, you accept the new terms.
